NESTOMALT Salary For Life 2022 – Terms & Conditions

  1. Nestlé Lanka PLC, (hereinafter “Nestlé”) is hosting a competition for NESTOMALT called “NESTOMALT Salary for Life 2022” and/or “NESTOMALT Jeewithayata Wetupak 2022” and/or “NESTOMALT Valvitkorr Sambalam 2022” (hereinafter referred to as the “competition” for easy reference) at an all-island level.
  2. The competition is valid from 1st December 2022 to 28th February 2023 (hereinafter referred to as “competition period”). Participants must ensure that their entry/submission is made within this competition period. The competition is available for the above competition period only.
  3. Participation in this competition is optional and voluntary.
  4. Participation in this competition is open to all Sri Lankan citizens aged 18-50 only, except Nestlé employees, interns, trainees and their family members, Associate Companies, Employees or their family members of outsourced Service providers of Nestlé, employees and their family members of Advertising Agencies, Media Agencies and Partners, NESTOMALT 400g Bag In Box printing companies, unique codes generating and technical service providers.
  5. The competition is applicable only for the NESTOMALT 400g Bag In Box packs printed with the unique codes produced from 8th September 2022.
  6. Winners and the family members of previous editions of NESTOMALT Salary For Life cannot participate in this competition.
  7. This is only a prize competition and not a job/employment opportunity/offer.
  8. The participants need to send the alphanumeric unique code which is printed on the inner top flap of the NESTOMALT 400g Bag In Box pack via sending an SMS to 4252 in the below format.

  9. Entries which do not meet the above format and criteria will be rejected.
  10. Participants who meet the above entry criteria are entitled for a digital draw to win Rs. 50,000/- on a monthly basis commencing from April 2023, till the winner turns 55 years of age (hereinafter referred to as the prize) subject to terms and conditions hereto. In the event of the death of the winner, the monthly payment will no longer be paid.
  11. Prize will be given only to the holder of the respective National ID card number which was mentioned in the SMS entry.
  12. To claim the prize, it is mandatory to present the empty pack that has a valid batch code and the selected unique code. This empty pack should be presented to Nestle immediately at the time of request. The Winner will be disqualified in an event the winner is unable to produce the Empty Pack of Nestomalt carrying the winning Unique Code.
  13. Only 1 winner will be selected.
  14. SMS charges will be applicable for submission of entries.
  15. The winner will be selected in March 2023 under the supervision of the Department of Revenue – Western Provincial Council.
  16. One unique code can be sent only once. However, one person can send any number of different unique codes mentioned on different packs and those will be considered as separate entries to the competition.
  17. One consumer is entitled to win only one prize, and the prize will only be awarded if the winner grants written consent to be a part of the amplification of the competition by entering into a written contract renewable on an annual basis. In case if the contract is not renewed, the payment of prize shall be discontinued.
  18. The winner shall not appear in any amplification competition of competitive products of Nestlé Lanka PLC.
  19. There is no employee-employer relationship between the winner and Nestlé Lanka PLC. Therefore, a monthly payment of the prize is not a salary or wage and the winner is not entitled to claim any statutory payments such as EPF (Employee Provident Fund), ETF (Employee Trust Fund) or gratuity
  20. Winners will be informed by means of a letter with a reference number, of which original needs to be produced when collecting the prize.
  21. The original letter from Nestlé should be submitted to collect the prize by the winner along with their National ID/ Passport for verification of identity and the age of the winner.
  22. No copies of the original letter from Nestlé shall be entertained.

  24. Nestlé shall not be liable to any complaints due to negligence or acts of omission committed by the prize winner.
  25. The winner will be called upon to collect their prize agreement and to participate at organised NESTOMALT events.
  26. Expense incurred to collect the prize will have to be borne by the winners.
  27. The winner shall be published in national newspapers/ TV/ Radio/Digital platforms post the competition.
  28. By participating in this competition:

    a) The participant expressly confirms and represents that he/she has read the Terms & Conditions of the competition on how to enter, how the winning entry shall be determined, and details on collection, retention, usage and sharing of personal data and image.

    b) The participant agrees to be bound by the terms, including in particular those relating to the collection, retention, use and sharing of personal data; and image.

    c) The participant confirms that he/she is not breaching any law or violating any third-party rights by participating this competition.

    d) The decision of Nestlé on the selection of the winner shall be final and binding, and no correspondence will be entertained in this regard.

    e) The winner shall be entitled to the prize as decided by Nestlé and subject to the agreement to receive the prize as monthly payments until the winner reaches 55 years of age.

    f) The awarding of the prize is subject to verification by Nestlé. Nestlé shall use basic audit standards to verify the legitimacy of the winner. In case there are any conflicts in the legitimacy of the winner, Nestlé is entitled to quash the prize at any given point against such claimed winner or participant. In case the winner is not verified internally or not reachable or they cannot redeem the prize for any reason whatsoever, Nestlé will reserve the right to pass on the prize to another participant without any further notice to the winner.

    g) In case a participant is not contacted/intimated/declared as a winner, it shall automatically mean that the person's name has not come through the selection process and that he/she is not a winner.

    h) The prize is non-transferable. No claim shall be entertained in this regard.

    i) By participating in this competition, the participant permits Nestlé to use the participant's name, photo, voice, entry, and other relevant details for purposes of publicity, edition, presentation, brand study, market research, advertising and/or trade without further approval, permission, compensation or notice for an unlimited period.

    j) No consideration is payable by Nestlé against the use of any entries received for the competition.

    k) Nestlé reserves the right to reject, delete, or remove any entry without assigning any reason thereof. Any decision taken by Nestlé for rejecting, deleting or removing any answer/entry shall be final and binding, and not subject to any dispute or challenge.

  29. Nestlé reserves its rights to cancel or remove any answer/entry or usage of the competition by any participant at any point of time, at its discretion. The decision of Nestlé shall be final and binding on this.
  30. Failure of the participant to adhere to the above, gives the right to Nestlé to disqualify the entry from the competition.
  31. Nestlé reserves the right to withdraw, change, defer, alter or cancel this competition in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of Nestlé in this regard and in general with respect to this competition and the terms and conditions thereto shall be final, binding.
  32. Nestlé shall not be liable for any loss or damage due to Act of God, Governmental actions, other Force Majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.
  33. If a participant is dissatisfied with the competition and/or the terms and conditions of the competition, his/her sole and exclusive remedy is to not to participate in the competition.
  34. Entries received after 28th February 2023 will be rejected.
